The Throne and Catholics
Last week, I talked about the Duchess of Kent converting to Catholicism along with several members of her family, most notably her son Lord Nicholas Windsor who married in the Vatican last year. The British constitution, specifically the Act of Settlement of 1701, prohibits Catholics and those who marry Catholics from ascending to the throne. This part of the constitution has its roots with Henry VIII and the fight among his daughters, the Catholic Mary and Protestant Elizabeth. Today, it means that if Prince William fell madly in love with a nice Catholic girl, he would have to step aside and forfeit his right to be king. Since Kate Middleton isn't Catholic, we probably don't have a problem in the upcoming generation, but how relevant is the law in the 21st century? Are Catholics still the enemy of the British state? Remember, Prince Charles wants to be the Defender of Faiths, not a singular Faith, when he becomes King. Now full disclosure here -- I'm Catholic. The last time I checked, however, there's not a whole lot of difference between Catholics and Anglicans and, in fact, Anglican priests can become Catholic priests fairly easily, even the ones who are married! Is it worth invoking a constitutional crisis if a prince or princess fallsin love with a Catholic? I think not. By the way, the Duchess of Kent's husband retains his place in line because she was Protestant when they married in the 1960s. Lord Nicholas gave up his place upon his conversion, and his older brother the Earl of St. Andrews lost his place in line when he married a Catholic. Confused?
